When the government has little incentive to interfere, the government isn't going to enable the courts to make decisions. When you let the government decide what information should exist and which should not, you're providing strong incentives for it to pass laws that push courts in a direction most people would not like.

What Loki neglects to mention is that the US government is beholden to political party influence....and our politicians won't pass legislation that "limits" their own influence, or their paid lobbyists. Freeedom!
I'll believe our politicians are freedom loving Constitutional advocates.....when they remove NFL 'administrators' from non-profit tax exempt status.

Government will get to decide only in those matters that eventually come before it. Before then, individuals and their lawyers will have to decide whether or not it's worth it to sue for removal and corporations will have to decide whether or not it's worth it to fight such a suit. I'm not sure if that's a good thing, but there are some possible checks inherent to these cases.

Few individuals can make their case in court without private lawyers. It doesn't matter that "if you can't afford a lawyer, one will be appointed to you without charge"...if that public defender is underpaid and overworked.
The "right" to be anonymous is weighed against the "right" to be recognized. It's complicated, and ultimately political. Guess which entity usually prevails.

In this case the corporations want to make as few of these decisions as possible.
